• List of goods and services classified under the Nice Classification (11th edition)

Step-by-Step:How to Register a Trademark in Guatemala

1. Conduct a Preliminary Trademark Search (Optional but Recommended)

Before filing, search the RPI database to check forexisting trademarks that may be similar. This reduces the risk of objections or oppositions later in the process.

2. File the Trademark Application

You can submit your trademark application either:

• In person at the Intellectual Property Registry (RPI),     or
• Online through the VERPI (Electronic Window  of Intellectual Property)

3. Formal and Substantive Examination (3 to 5 weeks)

The RPI will:

• Review all submitted documents
• Ensure the mark complies with Guatemalan trademark law
• Notify you if any information is missing (you have 1 month to  respond)
• Issue objections if a conflict with an existing trademark is found  (you have 2 months to reply)

If the application is rejected on legal grounds, a Motion for Reconsideration can be filed within 5 business days.

4. Publication in the Official Gazette (BORPI)

If the application passes examination:

• A public notice (edict) is issued and must be published within 6  months
• Third parties may file oppositions within 2 months of publication

5. Final Registration

If no oppositions are filed:

• The RPI issues a resolution granting registration
• Final registration fees must be paid

A trademark registration certificate is issued approximately 30 days after payment.
