Why Trademark Registration Matters

A registered trademark is more than just a logo or brand name: it’s a legal asset!

Registering your trademark in Guatemala:

  • Gives you exclusive rights to use your brand
  • Enables you to prevent others from using similar marks
  • Allows you to take legal action against infringement or  counterfeiting
  • Increases the value of your business and builds consumer trust

Whether you're a startup or an established company, securing your intellectual property rights in Guatemala is essential for long-term success.

Trademark Registration Requirements in Guatemala

To begin the process, the following documents and details are required:

  • Completed official application form (available through the RPI or VERPI portal)
  • Applicant information: full  name, legal entity details, address, and contact information
  • Representation of the mark: logo, wordmark, or image in digital or printed format
  • Trademark description:   distinctive elements, use of colors, etc.
  • List of goods and services classified under the Nice Classification (11th edition)
  • Power of attorney or  appointment of a legal representative (if applicable)
  • Proof of payment of the official government fees

📌 Tip from a Trademark Lawyer: Submitting a clear and detailed description of your mark and choosing the correct classification is critical to avoid delays or rejections.

Step-by-Step:How to Register a Trademark in Guatemala

1. Conduct a Preliminary Trademark Search (Optional but Recommended)

Before filing, search the RPI database to check forexisting trademarks that may be similar. This reduces the risk of objections or oppositions later in the process.

2. File the Trademark Application

You can submit your trademark application either:

  • In person at the Intellectual Property Registry (RPI),     or
  • Online through the VERPI (Electronic Window  of Intellectual Property)

3. Formal and Substantive Examination (3 to 5 weeks)

The RPI will:

  • Review all submitted documents
  • Ensure the mark complies with Guatemalan trademark law
  • Notify you if any information is missing (you have 1 month to  respond)
  • Issue objections if a conflict with an existing trademark is found  (you have 2 months to reply)

If the application is rejected on legal grounds, a Motion for Reconsideration can be filed within 5 business days.

4. Publication in the Official Gazette (BORPI)

If the application passes examination:

  • A public notice (edict) is issued and must be published within 6  months
  • Third parties may file oppositions within 2 months of publication

5. Final Registration

If no oppositions are filed:

  • The RPI issues a resolution granting registration
  • Final registration fees must be paid

A trademark registration certificate is issued approximately 30 days after payment.

Online Trademark Registration via VERPI

The VERPI system allows applicants to manage the entire trademark process digitally. Here's how it works:

  1. Create an account and log in to the RPI portal
  2. Complete the application form online
  3. Upload supporting documents in digital format
  4. Make payments electronically
